When can I make repairs in the apartment
The endless noise from the hammer and puncher is capable of driving even the most balanced person out of himself. These sounds are especially annoying if they are heard from early morning until late at night. In order to minimize neighborly hostility and not have problems with the law, you need to know exactly when you can make repairs in the apartment.
The legislative framework
The time of repair work in an apartment building is regulated by several regulatory legal acts:
- The Law of Silence (Federal Law No. 52, adopted in 1999, the latest relevant amendments were made in 2017). According to this document, from 23:00 to 7:00 there is a time of silence in the apartments. No noise above 30 decibels should be emitted in this time period.
- Chapter 4 of the Housing Code of the Russian Federation. It regulates the basic provisions on when and how noisy repairs can be carried out. It also indicates that the regional authorities themselves can set the permissible hours of work in apartments.
- Article 293 of the Civil Code of the Russian Federation. This document allows local governments to issue a warning to a person who violates the rights of neighbors. If you haven’t reacted to the remark, the case may go to court and even to eviction. However, the latter happens extremely rarely, and almost always the offender is limited to paying an administrative fine.
- Decisions of local authorities. Most regions have their own rules regarding the repair of apartments. So, if in Moscow you can not make noise after 21:00, then in some regions of Russia, work is allowed until 22:00.
When to make repairs
In most regions of Russia, the following time frames apply:
- On weekdays, repairs can be carried out from 8:00 to 21:00. On weekends, as well as on public holidays, the valid time period is from 10:00 to 22:00.
- From 13:00 to 15:00 noisy work must be stopped. The rule is valid every day, including on weekends. Interestingly, this only applies to repair - making chops or listening to loud music in the afternoon is completely legal.
- Work with a high noise level (it is produced by a puncher, drill, hammer, etc.) is allowed only from 9:00 to 19:00. On weekends - no earlier than 10:00. Any electrical appliances should only be used in this time period.
On January 1, 2016, new rules were adopted in Moscow, according to which, on Sunday and on holidays, work with a high noise level should be abandoned altogether. So far this "tightening" is valid only in the capital.
The total duration of repair work should not exceed 4 months. If this period is not enough, the owner of the apartment should contact the housing inspectorate for permission.
In new buildings (houses commissioned less than 18 months ago), relaxed rules apply. On weekdays, repairs can be done in them from 7:00 to 23:00 without a break at daytime "quiet time". On weekends and holidays, general rules apply.
In some regions of Russia, repairs are allowed until 22:00. But if a person is not completely sure that this is permitted in his city, it is better to observe the general time frame.
In addition, it is forbidden to use tools that emit noise and vibration above established standards. Such devices cannot be found in specialized stores, but an old or a drill purchased on the market may well be illegal. Exceeding the permissible noise level is prohibited even during the day.
Repair in the apartment may take several months.The main reason for this is the serious restrictions on the permissible time of work. In order to do everything quickly and within the framework of the law, it is advisable to combine repairs with vacation and work during the day, while the neighbors are not at home.
